1. Introduction

Welcome to DeepFans (“we,” “our,” or “us”). These Terms of Service govern your use of our website, mobile app, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, please stop using the Platform immediately.

2. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to create an account or use our services. If you are under 18, you may only use the Platform with parental consent and under supervision. We do not knowingly collect or allow content involving minors.

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and up-to-date information.
• Keep your login credentials secure.
• Be responsible for all activity under your account.

We reserve the right to suspend or terminate accounts for violation of these Terms or applicable laws.

4. Use of the Platform

You may use the Platform only for lawful and responsible purposes. You may not:

• Upload or generate content that is illegal, explicit, or infringes on others’ rights.
• Create or distribute content depicting minors in any sexual or exploitative way.
• Impersonate others or misrepresent your identity.
• Interfere with the Platform’s operation or security.
• Use AI-generated content to defame, harass, or mislead others.

Violation may result in suspension, content removal, or legal reporting.

5. AI-Generated Content

Our tools allow users to generate AI-based photos, videos, and text. You retain ownership of your original inputs, but you grant the Platform a non-exclusive, worldwide, royalty-free license to host, display, and use generated content for service delivery and moderation.

You understand:

• AI outputs are probabilistic and may not always be accurate or realistic.
• You are solely responsible for the content you generate or share.
• The Platform may use automated and manual review to ensure compliance.

6. Creator & Fan Content

For creators:

• If you participate as a registered Creator, you must sign our Creator Likeness Consent Agreement.
• You may set permissions and restrictions for your likeness use.

For fans:

• You may not create realistic likeness-based content of a real person without explicit consent.
• Non-consensual or sexualized depictions of real individuals are strictly prohibited.

7. Payments & Refunds

Paid features, credits, or subscriptions are processed through Stripe, Apple, or Google Pay. All prices are displayed before checkout.

• Payments are final once generation begins.
• Refunds may be issued only for duplicate payments or technical failures.
• We do not store full payment card details.

Creators’ payouts follow our Payment & Risk Policy.

8. Intellectual Property

All Platform technology, branding, and user interface elements are owned by DeepFans. You may not copy, reverse engineer, or resell any part of the service. Users retain rights to their uploaded and generated content, subject to the license granted under Section 5.

9. Moderation & Enforcement

• Remove or block content that violates these Terms or law.
• Suspend or delete accounts for repeated violations.
• Report illegal activities to authorities (e.g., CSAM, harassment, fraud).

All moderation actions are logged for audit and transparency.

10. Termination

You may delete your account at any time via your account settings. We may terminate or suspend your access if:

• You breach these Terms;
• You engage in fraud or abuse;
• Your activity poses a risk to users or the Platform.

Termination does not affect any outstanding payment or legal obligations.

11. Disclaimers

• The Platform is provided “as is” and “as available.”
• We make no warranty that AI outputs will meet expectations or be free from bias or error.
• We are not responsible for any loss caused by reliance on generated content.
• To the extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

12. Limitation of Liability

• We are not liable for indirect, incidental, or consequential damages arising from your use of the Platform.
• Our total liability shall not exceed the greater of (a) the amount paid by you within the last 12 months, or (b) USD $100.

Some jurisdictions do not allow such limitations; in those cases, local law applies.

13. Copyright & DMCA

If you believe content on the Platform infringes your copyright, send a notice to Support@motionfantasy.com including:

• Your contact details
• The infringing material’s location (URL)
• Proof of ownership
• A sworn statement of good faith

We comply with the Digital Millennium Copyright Act (17 U.S.C. §512) and EU equivalents.

14. Privacy

Your use of the Platform is governed by our Privacy Policy, which explains how we collect and process your data. By using our services, you consent to these practices.

15. Governing Law & Jurisdiction

• For U.S. users: these Terms are governed by the laws of California, U.S.A.
• For EU/EEA users: governed by the laws of the Netherlands.

Disputes shall be resolved in the courts of San Francisco (U.S.) or Amsterdam (EU), unless otherwise required by law.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced at least 7 days before they take effect. Continued use after that date means you accept the revised Terms.
